• If you’re unmarried and want assets to go to a partner, a close friend, or a charity, intestate succession won’t accomplish that. A will or trust is required.
• Minnesota’s 120-hour survivorship rule (Minn. Stat. § 524.2-104) requires a beneficiary to outlive the decedent by at least five days to inherit under intestacy.

Non-probate assets, including accounts with named beneficiaries and jointly held property, pass outside intestate succession regardless of whether a will exists.
